The undersigned represents and warrants that he / she has received, read and understood the provisions of this Application, and has the requisite power and authority to execute and deliver this "APPLICATION FOR BERTH," and to bind the Applicant, the vessel, and its Owners, Managers, Operators, Charterers, and agents to carry out and perform all of the terms, conditions, and covenants of this Application.
By submitting this APPLICATION FOR LAYBERTH (“Application”), furnished by Vulcan Construction Material, LLC’s (“Vulcan”) steamship agent, the party signing the Application (“Applicant”), agrees that it has read and understood, has accepted, and shall comply with, and be responsible for all the terms and conditions of Vulcan’s STANDARD TERMS AND CONDITIONS (“STC”), including Addendum No. 1 (Rate Sheet) to the STC.
